Codicil to a will in Ireland: What it means and why you might need one

What Is a Codicil?

A codicil is a short legal document that allows you to make amendments to an existing will. It’s often used to make small changes, such as:

  • Updating the name of a beneficiary
  • Changing executors
  • Modifying a specific bequest (e.g. changing the amount of a gift)

It is legally binding and must be signed and witnessed, just like a will.

When Should You Use a Codicil?

You should consider a codicil if:

  • Your changes are minor or straightforward
  • The rest of your will still accurately reflects your wishes
  • You want to avoid the cost and effort of rewriting your will

However, if your changes are extensive or likely to cause confusion, we may recommend drafting a new will instead. We’ll advise you clearly on which option is best for your situation.

Legal Requirements for a Codicil in Ireland

To be valid in Ireland, your codicil must:

  • Be made voluntarily and by someone with legal capacity
  • Be in writing
  • Be signed by the testator in the presence of two independent witnesses
  • Be stored safely with your original will

Failing to meet any of these conditions could render your codicil invalid.
