We advise landlords and tenants on all aspects of residential tenancies in Ireland, from drafting an appropriate lease to resolving disputes through the Residential Tenancy Board. Whether you are an “accidental landlord” letting a single property or- a landlord with multiple properties, we can guide you through your rights and obligations in plain English.
Based in Waterford, we act for clients across the South East, bringing together a solid understanding of residential tenancy law with a practical, straightforward approach to resolving disputes.
We have advised landlords and tenants across Waterford and the South East for many years, so we understand both the legal detail and the practical pressures involved in a tenancy dispute. We explain your options clearly, so you can make an informed decision rather than facing a confusing process alone.
Do I need a written tenancy agreement?
It’s strongly recommended. Although “oral tenancies” exist, they are an unnecessary risk with lots of pitfalls as understanding and recollections often vary over the passage of time. A written agreement sets out both parties’ obligations clearly, cannot change without agreement between the parties, and helps avoid disputes later. We can review or prepare one for you.
What notice does a landlord have to give to end a tenancy?
This depends on how long the tenancy has run. We can confirm the exact notice period that applies to your situation.
What happens if my deposit is not returned?
Deposit disputes can usually be resolved through the RTB’s dispute resolution service. We can advise you on the process and represent you if needed.
Can I be evicted without going through the RTB?
Not legally. In order to be compliant with the relevant legislation, a landlord must follow the proper legal proces to end a tenancy, and most disputes over a termination are dealt with by the RTB.
What if my tenant stops paying rent?
There is a defined process for dealing with rent arrears, including notice requirements built into to applicable tenancy legislation. We can advise you on the correct steps to protect your position.
